Dumpster Permits in the City Right-of-Way


An Occupancy Permit is required to place a commercial dumpster or roll-off container in the City of South Bend's public right-of-way, which includes:

  • Streets
  • Parking lanes
  • Alleys
  • Tree lawns

Dumpsters are not permitted on sidewalks. Permits are issued through the City's Engineering Permits Office.



Can I use any dumpster company?

No. If a dumpster will be placed in the public right-of-way, you must use a dumpster company that is bonded with the City’s Public Works Department. The companies bonded with the City are listed below:

You need to contact a bonded dumpster company to order a dumpster. The dumpster company will submit the permit application on your behalf. Once approved, the company may place the dumpster in the permitted location.


What if my preferred dumpster company is not bonded?

If your chosen dumpster company is not bonded with the City, the dumpster cannot be placed in the public right-of-way. It must be placed on private property.

Dumpster companies interested in becoming bonded with the City's Public Works Department should contact the Engineering Permits Office at rowpermitsoffice@southbendin.gov to request an Occupancy Bond form.


Information for Contractors

Contractors who are bonded with the City's Public Works Department may obtain an Occupancy Permit under their own company name for a dumpster provided by a non-bonded dumpster company.

Permit applications are now submitted electronically and can be found at southbendin.gov/engineering.  Please allow at least three (3) business days for processing dumpster permit requests.


How long can a dumpster remain in the right-of-way?

There is no time limit for how long a dumpster can remain in the public right-of-way. If a dumpster remains in the right-of-way for more than 90 days, a Long-Term Occupancy Permit is required. This process includes additional insurance, fees and approval by the Board of Public Works. Approval may take several weeks.


Can residents apply for a dumpster permit?

No. Residents cannot apply directly for an Occupancy Permit for a dumpster. Residents need to contact a bonded dumpster company, which will handle the permit application process.
